James Robertson featured in the press on the new division of the High Court
Our Commercial Disputes Partner James Robertson has been quoted in the legal press on the creation of a new division of the High Court.
The move was announced by Baroness Carr who confirmed the creation of the Business and Property Division of the High Court, to replace the current Chancery Division. The new division will deal with commercial disputes including, disputes relating to business, trademarks, patents, insolvency and bankruptcy.
The change aims to improve access to justice. Under the current system, different types of high value commercial and business disputes are handled by two different sections of the High Court. The change is expected to come into force in October.
James Robertson comments: “In circumstances where both the County Court and High Court are often accused of shocking delays in administering cases, any measure taken to reduce waiting times and increase access to justice should be lauded. However, we have to be extremely careful in ensuring that there is no decrease in the quality of the service provided.”
