Chidi Egbochue featured in Law Society Gazette on construction disputes
Chidi Egbochue has been featured in the Law Society Gazette, commenting on the controversial adjudication system for construction disputes put in place following Sir Michael Latham’s review in 1994.
Property journalist Maria Shahid explains that Sir Michael’s Constructing the Team report advocated for simplifying the contracting process and introducing standardised contracts, and introduced a ‘pay now, argue later’ system, which was formalised by the Housing Grants, Construction and Regeneration Act 1996.
“Adjudication was always intended to be ‘rough justice’, to achieve a temporary resolution of a dispute, which could be the difference between a successful referring party going out of business and surviving,” notes Chidi.
