Family Partner Nick Gova comments on Standish v Standish in Edward Fennell’s Legal Diary

Family Partner Nick Gova features in longstanding legal journalist Edward Fennell’s Legal Diary, providing expert commentary on the Standish v Standish divorce case currently before the Supreme Court.

The case examines whether a £77 million transfer of assets from husband to wife during the marriage should be considered part of the matrimonial pot. If the assets have been effectively ‘matrimonialised’, they should therefore be divided equally.

Nick explains: “This case highlights the long-term legal and financial implications of gifting or transferring substantial assets between spouses during a marriage. While such transfers may be driven by tax or estate planning objectives, they can later become central to disputes in divorce proceedings.”

The Supreme Court’s ruling could offer clarification on whether gifts within marriage – even those made for the benefit of children – should be treated as part of the couple’s shared marital assets or remain separate.

Nick adds: “The outcome may have significant implications for couples who structure their finances in this way, particularly where large sums or trusts are involved.”
