Family Partner Nick Gova features in FT Adviser with an article discussing the government’s new consultation on cohabitation rights this year, which comes in response to calls for reform. Despite being the fastest-growing family type, cohabiting couples have little legal protection, often leaving the financially weaker partner vulnerable if the relationship ends.

The number of cohabiting couples rose by 144% between 1996 and 2021, yet legal protections remain minimal. Unmarried partners have limited rights over property, inheritance, pensions, and bereavement support. Many wrongly assume joint property ownership provides security, when in reality, they risk financial hardship. Without a will, a surviving partner may receive nothing.

Nick writes: “Cohabiting couples are the fastest growing type of family in the UK, but they are ignored by the law as it stands.”

Legal experts recommend cohabitation agreements, but awareness is low. Proposals for reform include an opt-out cohabitation scheme to protect vulnerable partners, particularly victims of domestic abuse. Labour has pledged to strengthen rights for cohabitants, and government ministers confirm reform is on the agenda.

While necessary, any changes must balance protections for cohabitants with the rights of married couples. Financial planners should stay informed on developments.
