Nick Gova features in legal press on Potanin Court of Appeal decision

An appeals court has overturned a prior decision in the high-profile Potanin v Potanina case, allowing Mrs. Potanina to pursue a Part III claim for a greater share of her former husband’s fortune.

Featured in the Law Society Gazette and Today’s Family Lawyer, Head of Family Nick Gova explains that English courts are known for their “generous approach to the financially weaker spouse,” recognising non-financial contributions.

The Russian couple divorced in Russia, with Mrs. Potanina receiving a very small share of their wealth.

While critics call this “divorce tourism,” Nick argues it’s about applying principles of fairness when a spouse with a “genuine connection to this jurisdiction” may not have otherwise received a fair share of the wealth.
