Gary Scott writes in The Times on scrapping section 21

Partner Gary Scott has been featured in The Times with an opinion piece discussing the proposed scrapping of section 21 through the Renters’ Rights Bill.

Explaining that although ending no-fault eviction seems to be a “worthy measure designed to tackle unscrupulous landlords”, Gary notes that these are only a tiny minority, so it is unlikely that the number of possession claims will fall.

Instead, claims will take longer, as the landlord must prove the ground for possession before an order is made.

“By failing to tackle the backlog already in the courts and tribunals or investing properly in digital processes to help streamline the system, the government risks landlords losing faith in the system,” says Gary.

He points to the unintended but serious consequences – landlords will start to leave the market, meaning that there are fewer rental properties in an already scarce market.

“This risks a reduction in available rental properties... a situation where tenants will lose out too – the very thing the government wanted to avoid,” states Gary.
